The Fair Trade Software Foundation Regulations
Valid from January 1, 2019
Despite our striving for a transparent and careful way of working, things can still go wrong. If you have a complaint, we appreciate that you first contact the relevant employee of our CodeBuddies project. Can’t figure it out together? In that case, this complaints procedure provides for the further steps you can take.
If you do not agree with a decision by The Fair Trade Software Foundation on an application, you can submit a request for reconsideration of this decision within three months of receipt. See the procedure for a reconsideration request.
If you suspect fraud by an organization that has requested and/or received a financial contribution from The Fair Trade Software Foundation, please contact our Community Manager at yasmine@competa.com.
Article 1 In these regulations the following definitions apply:
- a) The Fair Trade Software Foundation: The Fair Trade Software Foundation, established in Rijswijk;
- b) the complainant: the person submitting a complaint and/or his authorized representative;
- c) complaint: expression of dissatisfaction with an act or behavior of The Fair Trade Software Foundation or of an employee working under the responsibility of The Fair Trade Software Foundation. Complaints can relate to the service as well as The Fair Trade Software Foundation
Article 2 These complaints regulations have the following objectives:
- a) to do justice to the individual complainant;
- b) promoting the quality of the service provided by The Fair Trade Software Foundation.
Article 3 Everyone has the right to submit a complaint to The Fair Trade Software Foundation about the way in which the CodeBuddies program, or persons who work under the responsibility of The Fair Trade Software Foundation, have or have acted towards him or her in a particular matter. or worn.
Article 4 The Fair Trade Software Foundation ensures careful handling of complaints.
Article 5 No appeal can be lodged against a decision on the handling of a complaint.
Article 6
- If the complaint relates to an act or behavior of an employee of The Fair Trade Software Foundation towards the complainant and meets the requirements as stated in the second paragraph of this article, the following articles 7 to 13 inclusive apply. .
- The complaint must be signed and contain at least:
- a) name, address, telephone number and e-mail address of the complainant;
- b) the date;
- c) name of the employee and a description of the behavior against which the complaint is directed.
Article 7 As soon as The Fair Trade Software Foundation has dealt with the complaint to the satisfaction of the complainant, the obligation to further apply these Complaints Regulations will lapse.
Article 8 The Fair Trade Software Foundation will contact the person submitting the complaint by telephone as soon as possible after receipt of the complaint. If the telephone treatment is not sufficient, a written confirmation will be given within five working days of how the complaint will be handled.
Article 9 The complaint is handled by the manager of the employee to whom the complaint relates. The director of The Fair Trade Software Foundation is informed of the receipt of a complaint.
Article 10
- The Fair Trade Software Foundation is not obliged to receive the complaint if it relates to an act or behaviour:
- a) about which a complaint has already been submitted and which has been dealt with in accordance with Articles 6 to 13;
- b) which took place more than three months before the complaint was lodged;
- The Fair Trade Software Foundation is not obliged to handle the complaint if the interest of the complainant or the weight of the behavior is apparently insufficient.
- The complainant will be notified in writing as soon as possible, but no later than four weeks after receipt of the written complaint, if the complaint is not handled.
Article 11
- The Fair Trade Software Foundation stelt de klager en degene op wiens gedraging de klacht betrekking heeft, in de gelegenheid mondeling een toelichting te geven.

- Van het gesprek tussen de klager en The Fair Trade Software Foundation wordt door The Fair Trade Software Foundation een verslag van gemaakt.
- Het verslag van het gesprek zal niet aan de klager ter beschikking worden gesteld. Wel heeft de klager het recht het verslag ten kantore van The Fair Trade Software Foundation in te zien.
Article 11
- The Fair Trade Software Foundation gives the complainant and the person to whom the complaint relates the opportunity to provide an oral explanation.
- This can be waived if the complaint is manifestly unfounded, or if the complainant has stated that he does not wish to make use of the opportunity to provide an oral explanation.
- The Fair Trade Software Foundation will make a report of the conversation between the complainant and Competa IT.
- The report of the interview will not be made available to the complainant. The complainant does have the right to inspect the report at the offices of The Fair Trade Software Foundation.
Article 12
- The Fair Trade Software Foundation will deal with the complaint as quickly as possible, in any case within a maximum of four weeks after receipt.
- The Fair Trade Software Foundation can postpone the settlement for a maximum of four weeks. The complainant and the person to whose conduct the complaint relates will be notified in writing of the adjournment.
Article 13 The Fair Trade Software Foundation will inform the complainant in writing, stating reasons, of the findings of the investigation into the complaint, as well as of any conclusions that the Fund attaches to it. It is not possible to appeal against these conclusions.
Article 14 The Fair Trade Software Foundation publishes the number of complaints received annually in its annual report. It also states what types of complaints have been submitted and what conclusions this has led to. Publications of complaints will always be anonymous.
Article 15 The scheme is evaluated every five years by The Fair Trade Software Foundation.
Article 16 These The Fair Trade Software Foundation, The Fair Trade Software Foundation Regulations entered into force on 01-01-2019, amended by the Board on 01-01-2021.
